Judge Mason sentences defendents in Elk county court Print E-mail

Judge Richard Mason continued sentencing defendants Monday afternoon at the Elk County Courthouse.
Heather Lynn Hulton, 20, of Weedville, pleaded guilty to one count of theft of leased property. She was sentenced to 12 months probation and must pay $30 supervision fees, a $150 fine, $200 restitution, and $274.25 in prosecution fees.
Hulton also pleaded guilty to one count of theft by deception and was sentenced to another 12 months probation that will be served consecutive to her previous sentence. She also must pay $30 supervision fees, a $150 fine, $141.67 in restitution, and $273.75 in prosecution fees.
Scott Bauer, 21, of Saint Marys, pleaded guilty to one count of receiving stolen property. He was sentenced to incarceration in at Elk County Prison for a period of 87 days to 24 months less one day with credit for time served. He will be eligible for parole on October 4 to be enrolled in a 28 day program at Maple Manor. He also must pay $30 supervision fees, a $300 fine, $1,490 in restitution, and $384.43 in prosecution fees. He also must provide a DNA sample and pay $250 for the cost of testing.
Jesse Robert Denio, 29, of Saint Marys, pleaded guilty to one count of criminal conspiracy and had his sentencing deferred until December. He will have to provide a DNA sample and pay $250 for the cost of testing, but this was also deferred until he is sentenced. He also had jury selection for another charge deferred until December as well.
James Vincent Biel, 23, of Wilcox, pleaded no contest to one count of simple assault. He was sentenced to incarceration at Elk County Prison for a period of 42 days to 24 months less one day with credit for time served of 42 days, so he would be paroled. He also must pay $30 supervision fees, a $300 fine, and $312.25 cost of prosecution. He also must have no contact with the victim as a condition of parole.
Letisha Close, 20, pleaded guilty to possession of a controlled or counterfeit substance. She was entered into the Intermediate Punishment Program for 12 months, with the first three months to be served under house arrest. Electronic monitoring must be paid for at her expense. She also pleaded guilty to possession of drug paraphernalia and was sentenced to 12 months probation to be served consecutive to her participation in the Intermediate Punishment Program. She also must pay $30 supervision fees, a $300 fine, $100 to the substance abuse fund, and $484.25 in prosecution fees. She also must attempt to earn her GED.
Rickey Antonuccio, 52, of Ridgway, pleaded guilty to eight counts of theft by deception. He was sentenced to three months of probation for each count, with each probation sentence running consecutively for 24 months total. This sentence will be consecutive to another probation sentence that was imposed on September 4, 2007. He also must pay $30 supervision fees, a $300 fine, $950.12 in restitution, and $273.75 prosecution fees.
Timothy Paul Singer, 34, of Saint Marys, pleaded guilty to two counts of driving after imbibing and had his sentencing deferred until November. He surrendered his drivers license.
Singer also pleaded guilty to one count of simple assault. He was sentenced to 12 months probation. He must also pay $30 supervision fees, a $300 fine, $567.25 in restitution, and $274.25 cost of prosecution.
Additionally, Singer pleaded no contest to an instance of deviant trespass. He was sentenced to 90 days probation to be served consecutive to his previous sentence. He also must pay $30 supervision fees, a $100 fine, and $268.75 in prosecution fees.
Singer also pleaded guilty to another instance of deviant trespass. He was sentenced to an additional 90 days probation to be served consecutive to his previous sentences. He must pay $30 supervision fees, a $100 fine, and $268.75 in prosecution fees.
Christopher Mohney withdrew as the attorney for Thomas W. Fitch.
Morris Charles Fleming, 30, of Glen Campbell, pleaded guilty to retail theft. He was sentenced to 24 months probation with the option to have probation transferred to Indiana County, where he currently resides. He also must pay $30 supervision fees, a $300 fine, $15.98 in restitution, and $277.45 in prosecution fees.
Steven Joseph Anders, 23, of Saint Marys, pleaded guilty to disorderly conduct. He was sentenced to 12 months probation. He must also pay $30 supervision fees, a $300 fine, and $274.25 in prosecution fees.
Shane Michael Nelson, 29, of Saint Marys, pleaded guilty to two counts of driving after imbibing. For each count, he was sentenced to consecutive terms of incarceration at Elk County Prison for a period of 30 days to six months. He also must pay $30 supervision fees, a $750 fine to be split between Elk County and Saint Marys, an Act 198 assessment fee of $150, $150 for Phase II countermeasures, $125 for the Influence Offenders program,  $35 for the court report network evaluation, and $472.75 in prosecution fees. He must also complete 50 hours of community service with a $7.50 insurance premium. His driving privileges were also suspended for 12 months and he must complete all treatment programs before his license will be restored.
Jon F. Dilley, 47, of Johnsonburg pleaded no contest to a charge of harassment. He must pay a $300 fine and $239 in prosecution fees.
Crystal Gail Dickant, 27, of Ridgway, pleaded guilty to theft by deception. She was sentenced to enrollment in the Intermediate Punishment Program for 18 months to be served consecutive to a sentence that was imposed on November 6, 2006. She must pay $30 supervision fees, a $300 fine, $264.80 in restitution, and $267.25 in prosecution fees. She also must exert the necessary efforts to attempt to earn her GED.
Tina Marie Akins, 21, of Emporium, failed to appear in court and a bench warrant was issued for her arrest.
Shawn Michael Redmond, 21, of Ridgway, had his probation revoked. He was sentenced to incarceration at Elk County Prison for a period of four to 18 months with credit for time served since August 15, 2007. He also must pay prosecution fees of $373.25.
Joshua Todd Bizzak will have his sentencing continued in November.
Karen Lee Dick will have her sentencing continued in November.
