Judge Richard Masson sentenced guilty defendants during yesterday's morning's session of Return Day at the Elk County Courthouse.
The first defendant to be sentenced was James R. Fallin, 50 of Wilcox. He was charged with robbery and theft by unlawful taking for the robbery of County National Bank in Johnsonburg earlier this year. Fallin had acquired approximately $21,000, and there has been a total of $21,435 recovered. He was sentenced to incarceration at the State Diagnostic Clinic in Pittsburgh for a minimum of five years and no more than 20 years with credit of time served since February 5. He is also to pay a fine in the amount of $500, restitution to be paid to CNB in the amount of $430.19, he is required to submit a DNA sample and assess the fee of $250, required to pay cost of prosecution in the amount of $1,001.79.
Adam Gregory Jones, 28, of Ridgway, was sentenced with incarceration for three to  60 months at the State Diagnostic Center in Pittsburgh with credit of time served, participate in the influence offenders program and pay fees of $150, Act 198 fees of  $100, a $1,500 fine with half to go to Elk County and the other half to Ridgway Borough. He is to serve 50 hours of community service and pay $30 of monthly supervision fees upon parole and will lose his license for 18 months for two counts of driving after imbibing charges. Jones was also charged with burglary and was sentenced in conjunction to his previous sentencing, 48 - 96 months incarceration with credit time served, pay a $30 monthly supervision fee and restitution in the amount of $40 to be paid to Carl Skilk. He is required to submit a DNA sample and pay the fee of $250 and pay the cost of prosecution in the amount of $274.75. In addition, Jones was charged with driving under a suspended license, for this charge he was sentenced to a $1,000 fine and $75 restitution to Ridgway Borough. All of Jones' sentences are concurrent.
Lee Allan Baum, 42, of James City, was charged with driving after imbibing and several other summary offenses. For these charges, Baum was sentenced to incarceration of 30 days to no more than six months with credit time served of 30 days with parole today, pay $30 monthly supervision fees, a $1,000 fine with half of the fine going to Elk County and half to the Commonwealth of Pennsylvania. He is also required to asses the $150 influence offenders program fee as well as Act 198 fees in the amount of $100. He is to participate in phase two with a fee of $150, serve 50 hours of community service and will lose his operating privileges for 12 months. He is also to pay the cost of prosecution in the amount of $358.75.
Harvey L. Detterline, 47, of Ridgway, was charged with selling or furnishing liquor, malt of brewed beverages to minors and was sentenced to incarceration for no less than 90 days and no more than 12 months effective yesterday. He is to pay $30 monthly supervision fees, a $1,000 fine and the cost of prosecution which is $276.75.
David Christopher Figley, 32, of Wilcox, was charged with contraband and was sentenced to incarceration for nine months and no longer than 24 months plus one day for credit time served from June 2, 2007. He is permitted to work release, pay $30 monthly supervision fees, a $500 fine and the cost of prosecution, $379,75. He is required to submit a DNA sample as well as asses the fee of $250.
Melody C. Lewis, 24, of St. Marys, was charged with theft by failure to make required disposition of funds received for the act of theft of Dominos Pizza in St. Marys. As the Chef Manager, Lewis had taken money on her own in the amount of $4,510.83. For the act of theft, Lewis was sentenced to probation for 24 months, pay $30 monthly supervision fees as well as restitution to Dominos Pizza and Scotsdale Insurance in the amount of $4,510.83. She is to pay a $500 fine, plus submit a DNA sample and pay the $250 fee. She is also required to pay the cost of prosecution in the amount of $333.75.
Earl Mickey, 23, of Belle Vernon, failed to appear in court so Judge Masson issued a bench warrant.
James Douglas Merat, 29, of Ridgway, was charged with criminal attempt and criminal conspiracy. Merat requested for deferment until July 7 as well as $5,000 straight bond with it being secured by 10 percent.
Matthew Lee Pumphrey, 24, of Dagus Mines, was charged with possession of drug paraphernalia and was sentenced to 12 months of probation and pay $30 in monthly supervision fees, as well as a $300 fine, $100 Act 198 fees, and the cost of prosecution in the amount of $381.75.
Richard Neil Russell, 18, of Brockport, was charged with burglary, theft by unlawful taking and criminal mischief. His sentencing was deferred until May 30 at 10:30 a.m.
James Matthew McDonald was charged with criminal attempt, contraband and possession of a controlled substance. For his case, his representation, George Daghir, requested further evidence from the Commonwealth of Pennsylvania. Judge Masson granted Daghir's request and gave the Commonwealth 30 days to supply the requested evidence.
Danielle Carol Klock, 23, of St. Marys, failed to keep the court administration and council informed of her information so Judge Masson issued a bench warrant.
Jeffrey Allen Marche, 28, of Kersey, did not complete the application for the Accelerated Rehabilitation Disposition (ARD) program, and was given until May 30 to complete, otherwise he will be ejected from the program.

The following defendants have all been charged with D.A.I. and have entered into the ARD program:
• Thomas S. Resch, of Kersey, had a blood alcohol content (BAC) of .25 and was sentenced to a 60-day loss of license, phase two, pay the cost of prosecution in the amount of $469.75 and $100 in assessment substance abuse fee. Resch was disqualified for the standard 35 hours of community service due to an injury.
• Lloyd Allen Nelson, 34, of St. Marys, has a BAC of .15 and was sentenced to 30-days loss of license, the cost of prosecution $519.75, $100 assessment substance abuse fee, 35 hours of community service and no phase two.
• Richard A. Hoy, 43, of St. Marys, has a BAC of .35 and was sentenced to 60-day loss of license, phase two, cost os prosecution $415.75, $100 assessment substance abuse fee and 35 hours of community service.
• Teressa Ann Walker, 24, of St. Marys, had no BAC, no loss of license, no phase two, $100 influence offenders program and the cost of prosecution $435.75. Walker was  also charged with unsworn falsification to authorities to the second degree, and for this she received six months of probation with the $30 monthly supervision fees.
• Brent Richard Cousins, 42, of Dagus Mines, had a BAC of .15 and was sentenced to 30-day loss of license, no phase two, cost of prosecution $519.75, $100 assessment substance abuse fees and 35 hours of community service.
• Ronald G. Lenox, 70, of Kersey, had a BAC of .22 and was sentenced to 60-day loss of license, phase two, cost of prosecution $519.75 and the $100 assessment substance abuse fee. Lenox was not required to serve 35 hours of community service due to his age.
